상가의 경우 서울(9.64%), 경기(5.10%), 부산(3.89%), 인천(2.39) 순으로 기준시가 상승폭이 크다. 유일하게 세종만 기준시가가 3.51% 하락할 것으로 보인다.

한편, 국세청은 매년 1회 이상 호별 ㎡당 기준시가를 ì‚°ì •í•´ 고시하고 있다. 기준시가는 상속·ì¦ì—¬ì„¸ì™€ 양도소득세를 과세할 ë•Œ 시가를 ì•Œ 수 없는 경우에 활용된다. 취득세·ìž¬ì‚°ì„¸ 등 지방세와 종합부동산세, 건강보험료 등 사회보험료 부과에는 활용되지 않는다.

이번 기준시가 ê³ ì‹œ 대상은 올해 9ì›”1일을 기준으로 조사한 ì „êµ­ 오피스텔과 수도권·5대 ê´‘ì—­ì‹œ·ì„¸ì¢…ì‹œ 소재 3000㎡ 또는 100호 이상의 구분 소유된 사업용 건물이다.

ê³ ì‹œ 대상 오피스텔·ìƒê°€ëŠ” 홈택스를 통해 기준시가안 조회가 가능하며, 이의가 있을 경우 이날부터 내달 8일까지 홈택스나 우편 등으로 의견을 제시할 수 있다.

이에 따라 국세청은 해당 의견을 검토한 후 평가심의위원회의 심의를 거쳐 12월30일 오피스텔과 상가의 기준시가를 최종적으로 고시할 방침이다.

양천소방서(서장 박찬호)는 지난 17일 양천구 목동의 한 오피스텔에서 화재가 발생했으나 단독경보형 감지기 덕분에 큰 피해를 막았다고 밝혔다.

소방서에 따르면 이날 화재는 오전 5시 56분께 목동의 한 오피스텔 4층 거주자가 안방에 켜놓은 전기장판의 열이 축적되면서 발생한 거로 추정된다.

다행히 화재로 연기를 감지하고 지속해서 울리는 화재경보기의 경보음을 들은 이웃주민이 119에 신고해 인명ㆍ재산피해를 방지했다.

화재경보기는 ‘단독경보형 감지기’라고도 불린다. 화재에 의한 열ㆍ연기ㆍ불꽃을 감지해 수신기를 거치지 ì•Šê³  독립적으로 내장된 음향오피사이트모음장치로 경보 알람을 송출하며 화재 생존율을 높이는 중요한 소방시설이다

16일 부동산 정보제공 ì—…ì²´ 경제만랩이 서울부동산정보광장을 통해 오피스텔 임대차 거래를 조사한 결과에 따르면 ì „ë‚  기준 올해 1~9ì›” 서울 오피스텔 ì „·ì›”세 거래는 총 5만723건으로 집계됐다. 전세는 2만3169ê±´, 월세 2만7554건이다. 이는 ì „ë…„(4만5073ê±´)보다 12.5% 증가한 수준이다. 오피스텔 임대차 거래는 서울부동산정보광장이 관련 통계를 작성하기 시작한 2011ë…„(1~9ì›” 기준) 이래 가장 많다.

월세 거래가 큰 폭으로 늘었다. 지난해 1~9월 서울 오피스텔 월세 거래량은 2만2575건이었지만, 올해 1~9월에는 2만7554건으로 전년 대비 22.1% 증가했다. 같은 기간 전세는 2만2498건에서 2만3169건으로 3% 상승했다.



서울 25개 자치구에서 오피스텔 월세 거래가 가장 많은 곳은 강서구다. 올해 1~9월 강서구 오피스텔 월세 거래는 4309건이다. 이어 △송파구 2484건 △마포구 2419건 △영등포구 2158건 △강남구 1509건 △관악구 1462건 △구로구 1416건 △동대문구 1381건 △은평구 1273건 △금천구 1243건 △강동구 994건 △서초구 826건 등으로 확인됐다. 반면 오피스텔 월세 거래량이 가장 낮은 자치구는 성북구로 올해 1~9월 153건으로 집계됐다.

월세도 상승세다. 서울 강서구 마곡동에 있는 '마곡역 센트럴 푸르지오 시티' 전용 23㎡는 지난해 9월 보증금 1000만원, 월세 64만원(9층)에 계약이 이뤄졌지만, 지난 9월에는 보증금 1000만원, 월세 85만원(14층)에 거래돼 1년간 월세가 32.8%(21만원) 상승했다.

송파구 문정동 '송파 아이파크' 전용 49㎡도 지난해 9월 보증금 2억원, 월세 71만원(11층)에 계약이 됐지만, 지난 9월에는 보증금 2억원, 월세 105만원(5층)에 거래돼 월세 47.9%(34만원) 상승했다.

오피스텔 월세 100만원 이상 거래량도 역대 최고치를 기록했다. 국토교통부의 실거래가 통계시스템에 따르면 올해 1~9월 월세 100만원 이상 월세 거래량은 2098건으로 관련 통계 작성 이래 가장 많은 것으로 나타났다.

특히 월세 거래량이 큰 폭으로 증가했다. 야짤지난해 1~9월 서울 오피스텔 월세 거래량은 2만2575건이었지만, 올해 같은 기간에는 2만7554건으로 전년 대비 22.1%(4979건) 늘었다. 같은 기간 전세는 3.0% 증가했다.

황한솔 경제만랩 리서치연구원은 “금리 인상 영향으로 오피스텔 월세 수요가 빠르게 늘어나는 추세”라며 “특히 오피스텔을 찾는 1~2인 가구의 주거비 부담이 커질 것”이라고 말했다.

서울 도심 한복판에서 초소형 오피스텔을 중심으로 매매가가 전세가 아래로 내려간 경우가 여럿 등장하고 있다. 통상 집값 하락기에 지방을 중심으로 나타났던 현상이다. 월세 거래가 많은 오피스텔 특성상 전세가 워낙 귀했던 데다, 서울의 매매가격 하락세가 가팔라지면서 이같은 현상이 일어난 것이다. 전문가들은 세입자가 전세로 오피스텔을 들어갈 때는 주의할 점이 많다고 조언한다.

16일 부동산빅데이터 플랫폼 아실에 따르면 서울 동대문구와 중구, 종로구 등 도심 한가운데 위치한 초소형 오피스텔을 중심으로 전세가격이 매매가격을 넘어서는 이른바 ‘깡통전세’ 현상이 나타나고 있다.

서울 동대문구 답십리동에 위치한 청계푸르지오시티 전용 18㎡는 지난 달 22일 1억5000만원(3층)에 전세계약이 체결됐다. 그런데 같은 달 1일과 16일 매매가격이 1억4000만원(21층), 1억5500만원(20층)을 기록했다.

2015년 2월 준공된 오피스텔인 오피모음 청계푸르지오시티는 총 460실로, 1동짜리 건물에 전용 18~30㎡인 초소형으로 구성됐다. 이 오피스텔의 전세가격이 매매가격을 본격적으로 넘어서기 시작한 건 7년차에 접어든 작년 초부터다.

답십리동의 í•œ 공인중개사무소 관계자는 “본래 오피스텔 전세는 귀한 편”이라면서 “1ë…„ ì „ 쯤부터 부동산 시장이 안 좋아지면서 전세가격은 유지되는데 매매가격이 꽤 떨어졌다”ê³  했다.

직장인 유동인구가 많은 중구의 황학동에 위치한 DUO302 오피스텔에서도 이런 사례가 나타났다. 전용 15㎡ 단일 평형인 이 오피스텔에서는 지난 9월 1억6000만원(12층)에 전세계약이 체결됐다. 그런데 매매계약이 10월 7일 1억5500만원(12층), 19일에는 1억5000만원(9층)에 각각 맺어졌다.

종로구에서도 마찬가지 사례를 찾을 수 있다. 숭인동의 종로중흥S클래스는 전용 17㎡ 전세계약이 지난 8월 31일 1억3500만원(16층)에 체결됐는데, 같은 달 매매계약은 1억3300만원(8층)에 체결됐다. 지난 달 5일에 맺어진 매매계약도 1억3400만원(14층)으로 전세가격보다 쌌다.

통상 전세가율이 80%를 넘어가면 집이 경매에 부쳐지더라도 전세보증금을 다 돌려받을 수 없는 깡통전세로 일컬어진다. 전문가들은 도심에서 전세가율이 100%를 넘어선 사례가 나온 이유로 ì• ì´ˆ 초소형의 경우 가격 자체가 상대적으로 저렴해 매매와 전세 차이가 작다 보니 갭투자가 많았던 점을 꼽는다. 하락장에 투자자들이 물건을 급하게 처분하다 ë³´ë©´ 깡통전세가 생기곤 했다는 게 전문가들의 설명이다. 고준석 제이에유투자자문 대표는 “세입자들은 반드시 전입신고를 í•´ì„œ 대항력을 갖추고 전세가율이 60%를 넘지 않도록 계약을 하는 게 안전하다”ê³  했다.

만일 공사대금 조정이 결렬된다면 소송을 제기해 해결할 수밖에 없다. 그러나 승소하더라도 승소로 얻는 금액이 실제 받아야 할 금액을 하회하고, 소송이 장기화하면 발주자와 시공사 모두가 손해를 보면서 승자 없는 싸움이 되는 경우가 많다. 따라서 가급적 조정을 통해 문제를 해결하는 것이 바람직한데, 극단적인 대립을 예방하고 신속한 조정에 이르기 위해 발주자와 시공사 모두 물가 변동 이슈에 관한 법령의 규정과 판례의 입장을 파악해 공감대를 형성할 필요가 있다.

국토교통부는2022. 4. 5. 질의 회신에서 ‘계약서상에 물가 변동으로 인한 계약 금액 조정은 하지 않는다는 내용이 명시돼 있는 경우, 물가 변동으로 인한 계약 금액 조정을 인정하지 아니할 상당한 이유가 없다면 ê·¸ 부분에 한정해 도급계약의 내용이 무효가 될 수 있다’는 입장을 밝힌 적이 있다.

그러나 물가 변동에 의한 공사대금 조정은 생각보다 만만치 않은 문제이다. 기본적으로 시공사는 발주자가 물가 변동을 반영한 절대 원가 보장에 소극적인 태도를 보여 부실 공사를 조장한다는 불만을 갖고 있다. 반면 발주자는 발주자대로 시공사가 공사 수주할 때는 상대적으로 낮은 금액을 약속하더니, 막상 도급계약을 체결한 이후에는 공사를 볼모로 공사대금을 반복적으로 인상하려 든다는 불만을 토로한다. 이렇다 보니 시공사가 일방적으로 공사를 중단하고 현장에서 철수하거나 발주자가 도급계약을 해제하고 공사대금 조정을 거절하는 등 극단적인 대립이 일어난 사례도 있다.
이처럼 도급계약 체결 이후 자잿값이 인상됐다면 적정 공사원가를 보장하기 위해 공사대금을 조정할 필요성과 합리성을 인정할 수 있고, 실제로 이러한 사정을 고려해 국가계약법(관급공사), 민간 건설공사 표준 도급계약(민간공사) 등은 모두 물가 변동을 공사대금 조정 사유로 규정하고 있다.
